Terms of Service

These Terms of Service (“Terms”) govern your use of the Ocean Drop mobile application (“the App”) and associated website operated by Ocean Drop (“we,” “our,” or “us”). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you:

  • Are at least 18 years of age.
  • Have the legal capacity to enter into a binding agreement.
  • Agree to comply with these Terms and all applicable laws and regulations.

If you are under 18, you may not create an account or use the App. If you do not agree to these Terms, you must not use the App.

2. Description of Service

Ocean Drop is a cycle-aware wellness and relationship support application designed to help users understand, track, and navigate menstrual cycle phases — either for themselves or to better support their partner. The App offers:

  • AI Chat Assistants — Drop (for him) and Marina (for her), AI-powered conversational companions that provide personalized cycle-aware guidance.
  • Daily Plan Engine — automatically generated daily plans with actionable suggestions tailored to the current cycle phase.
  • Mood Journal — a personal mood tracking tool to record and reflect on emotional patterns over time.
  • Calendar with Shared Visibility — a cycle calendar that can be optionally shared between connected partners.
  • Push Notifications — timely reminders and daily guidance delivered to your device.
  • Partner Connection — link with your partner via secure invite codes to share selected cycle information.

3. Important Disclaimers

Not a medical device. Ocean Drop is NOT a medical device under EU MDR 2017/745 or FDA regulations. The App does NOT provide medical advice, diagnosis, or treatment. Cycle-related information is provided for general wellness, educational, and supportive purposes only.

Not a substitute for professional help. If you or your partner are experiencing medical issues, mental health challenges, or relationship crises, please consult qualified healthcare providers, licensed therapists, or professional counselors. Never disregard professional medical advice or delay seeking it because of information provided by the App.

AI limitations. AI-generated responses are probabilistic in nature and may occasionally contain inaccurate or incomplete information. AI responses are NOT professional health advice and should not be relied upon as such. See Section 4 for full AI disclosure.

No guarantees. Wellness and relationship outcomes depend on many individual factors. We do not guarantee specific results from using the App.

4. AI Disclosure

Ocean Drop uses artificial intelligence to power its chat assistants and content generation features. By using the App, you acknowledge and agree to the following:

  • Marina and Drop are AI assistants. They are powered by AI language models and are not real people. They do not have feelings, personal experiences, or professional qualifications.
  • Responses are probabilistic. AI-generated content is produced by statistical language models. Responses may vary and are not deterministic.
  • AI may occasionally provide inaccurate information. While we strive for quality and accuracy, AI-generated responses may sometimes be incorrect, incomplete, or outdated. Always exercise your own judgment.
  • AI responses are NOT professional health advice. Nothing generated by Drop or Marina constitutes medical, psychological, therapeutic, or any other form of professional advice.
  • No liability for AI output. We are not liable for any decisions made or actions taken based on AI-generated content within the App.

5. User Accounts

To use certain features of the App, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorized use of your account.

You may only maintain one account per person. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Acceptable Use

You agree not to use the App to:

  • Harass, stalk, monitor, or control another person without their knowledge and consent.
  • Share another person’s sensitive health or personal information without their explicit permission.
  • Use cycle data or partner sync features to manipulate, coerce, or exert control over another person.
  • Distribute harmful, abusive, discriminatory, or illegal content.
  • Attempt to reverse-engineer, decompile, disassemble, or hack the App or its AI systems.
  • Use automated systems (bots, scrapers) to access the App or its services.
  • Attempt to extract, replicate, or misuse AI model outputs for commercial purposes.
  • Violate any applicable laws or regulations.

7. Partner Sync and Shared Data

Ocean Drop offers optional partner sync features that allow connected partners to share selected information. By using these features, you acknowledge and agree to the following:

  • Explicit consent is required. Both partners must actively and explicitly consent before any data is shared. The female user initiates and controls the visibility of her cycle data.
  • Either partner can disconnect at any time. Partner sync can be revoked by either party at any moment, immediately stopping all data sharing.
  • Scope of shared data. Data shared through partner sync is limited to: current cycle phase name, energy level, and mood. No raw health data, journal entries, or chat conversations are shared.
  • Prohibited misuse. You must NOT use shared cycle or mood data to manipulate, control, pressure, or harm your partner in any way. Violation of this rule will result in immediate account termination.
  • Connection method. Partners connect via secure, single-use invite codes generated within the App.

8. Subscriptions and Payments

Some features of the App require a paid subscription (“Ocean Drop Premium”). If you purchase a subscription, the following terms apply:

  • Payment processing. All payments are processed through the Apple App Store or Google Play Store. Ocean Drop does not directly collect or store your payment information.
  • Auto-renewal. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen plan.
  • Managing your subscription. You can manage or cancel your subscription at any time through your Apple App Store or Google Play Store account settings.
  • Refunds. Refunds are subject to the respective app store’s refund policy. We cannot issue refunds directly.
  • Price changes. We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use after the price change constitutes acceptance.

8.1 Free and Trial Tiers

Ocean Drop offers free access with the following limitations:

  • AI Chat limit. Free and trial users are limited to 5 AI chat messages per day. This limit resets daily. Only users with an active “Pro” subscription have unlimited AI chat access.
  • Core features. Cycle tracking, calendar, mood journal, daily plans, and partner connection are available to all users regardless of subscription status.
  • Trial period. New users may receive a trial period with limited access. At the end of the trial, the account reverts to free tier unless a subscription is purchased.

EU Cooling-Off Period. If you reside in the European Union, you acknowledge that by purchasing a subscription and accessing digital content immediately, you expressly consent to the provision of the digital content beginning before the end of the 14-day cooling-off period, and you confirm that you thereby lose your right of withdrawal with respect to that digital content, in accordance with Article 16(m) of the EU Consumer Rights Directive 2011/83/EU.

9. Intellectual Property

All content, design, code, branding, AI models, generated content, and materials in the App are owned by or licensed to Ocean Drop and are protected by applicable intellectual property laws. You may not:

  • Copy, modify, or distribute any App content without prior written permission.
  • Use the Ocean Drop name, logo, or branding without authorization.
  • Create derivative works based on the App or its AI-generated content.
  • Claim ownership of AI-generated content produced by the App.

You retain ownership of any personal data, journal entries, and other content you create and input into the App.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • We are not liable for any inaccurate, incomplete, or misleading information generated by the AI assistants (Drop or Marina), or for any decisions or actions taken based on AI-generated content.
  • Our total aggregate liability for any claims arising from or related to the App shall not exceed the amount you have paid for the App in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

11. Account Deletion

You may delete your account at any time directly within the App:

  • Navigate to Profile → Delete Account.
  • Confirm your decision through the double confirmation process.
  • Upon confirmation, your account and all associated data will be permanently deleted via database cascade. This action is irreversible.

Deleted data includes: your profile, cycle data, mood journal entries, chat history, partner connections, and all associated records. No backup copies are retained after deletion.

12. Termination

We may terminate or suspend your access to the App, without prior notice or liability, if:

  • You violate these Terms, including the Acceptable Use or Partner Sync provisions.
  • Your use of the App poses a risk to other users or the integrity of the service.
  • We are required to do so by law or regulatory authority.
  • We discontinue the App or any part of the service.

Upon termination, your right to use the App ceases immediately. You may request deletion of your data in accordance with Section 11 and our Data Deletion policy.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in law, best practices, or our services. When we make material changes:

  • We will update the “Effective date” and version number at the top of this page.
  • We will notify you through the App or via email at least 30 days before material changes take effect.
  • Continued use of the App after the effective date constitutes acceptance of the revised Terms.
  • If you disagree with any changes, you must stop using the App and delete your account.

14. Governing Law

These Terms shall be governed by and construed in accordance with the applicable laws of your EU member state of residence, including the full application of the General Data Protection Regulation (EU) 2016/679 (“GDPR”). We are committed to full GDPR compliance in the collection, processing, and storage of personal data.

Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation before pursuing formal legal remedies. If negotiation fails, disputes shall be submitted to the competent courts of your EU member state of residence, in accordance with applicable consumer protection rules.

If you reside outside the European Union, applicable local consumer protection laws may also apply to the extent they provide additional rights.
